ISOLAS LLP Partner Emma Lejeune, Senior Associates Stuart Dalmedo and Danielle Victor, and Associates Michael Adamberry and Jake Collado have been invited to contribute to the Gibraltar chapter of the Chambers and Partners Doing Business In … 2021 guide.

The guide covers 45 jurisdictions and provides the latest legal information on foreign investment restrictions, corporate vehicles, labor law, tax law, competition law, intellectual property (IP), data protection and upcoming legal reforms.

The Gibraltar chapter provides an overview of the Gibraltar legal system, which is largely based on English law (Common and Equity Law) and which is relevant to business operations. It describes the legal provisions and how the laws of the United Kingdom effect Gibraltar law. It also explains the judicial structure and the judiciary and how they differ from those of the UK. Legal proceedings are described and how the civil and criminal proceedings are carried out in Gibraltar.

Other matters covered include legal entities (corporations and trusts) how they are incorporated, managed and staffed; Competition law and rules and regulations relating to mergers, cartels and abuse of corporate power; Labor law, including contracts, compensation and termination among others; Tax Law and Gibraltar’s Various Tax Evasion Prevention Benefits and Provisions (Transfer Pricing and Small Capitalization Rules); intellectual property, process and protection, patents, trademarks, industrial design, copyright and ancillary matters; and data protection, its scope and security.

In addition, the chapter deals with EU law and Brexit, in particular the retention of certain EU laws in Gibraltar and the expected inclusion of the territory in Schengen law after Brexit.

Emma Lejeune, partner at ISOLAS, commented: “We are pleased to have again contributed to a Chambers Global Practice Guide. We hope that the information in the Gibraltar chapter will prove useful to those looking to do business within the jurisdiction and help them understand some aspects of the legal system of Gibraltar. We are at your disposal for any further clarification: [email protected]. “
